SURGAR, a simplified joint-stock company registered with the Clermont-Ferrand Trade and Companies Register under number 878 322 155, whose registered office is located at 22 RUE ALAN TURING, 63000 CLERMONT-FERRAND (hereinafter “SURGAR”) is concerned about the protection of Personal Data and undertakes to protect it in accordance with the applicable regulations and in particular Regulation (EU) No. 2016/679 of 27 April 2016 known as the “General Data Protection Regulation” or “GDPR” and the law n° 78-17 of 6 January 1978 as amended, known as the amended “Data Protection Act” (hereinafter the Personal Data Regulation”).

SURGAR operates a showcase site hosted at the address (hereinafter the Site”) offering a presentation of its services and structure. In order to allow visitors to visit the Site and make contact via the use of a form, SURGAR may be required to process Personal Data.

“Personal Data” means any information relating to an identifiable or identified natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by an identifier such as his or her name, an identification number, location data, an online identifier or a number of factors specific to physical identity, physiological, genetic, mental, economic, cultural or social of that natural person. The natural person whose Personal Data is processed is the “Data Subject”.

The purpose of this privacy policy (hereinafter the Privacy Policy”) is to recall the commitments made by SURGAR when it processes Personal Data, in accordance with the requirements of Personal Data Regulation.

2. RETENTION PERIOD

SURGAR undertakes to keep the Personal Data of the Data Subjects throughout the performance of the tasks that required their collection. Beyond that, SURGAR may archive Personal Data, in a secure environment in accordance with the Personal Data Regulations, for the applicable legal limitation period, for the purposes of evidence for the establishment, exercise or defense of a right in the context of judicial proceedings or administrative or extrajudicial proceedings.

3. DATA RECIPIENTS AND SUBPROCESSORS

Unless required by law or to do so by law, SURGAR will never disclose, assign, rent or transmit the Personal Data it processes to third parties, other than the following recipients:

 

  • SURGAR staff, within the strict framework of their duties, for the sole purpose of ensuring the purposes of the processing as recalled above;
  • The hosting provider of the Site and its databases: 02 Switch;
  • The customer relationship service provider (CRM) and internal management;
  • Third-party cookie publishers, under the conditions set out below.

 

It is specified that the above-mentioned third-party service providers act as “subprocessors” of SURGAR within the meaning of the Personal Data Regulations, on the instructions of SURGAR, which provides them with the data strictly necessary for the performance of its missions, under the contractual conditions signed with SURGAR which cannot derogate from this Privacy Policy and which comply with the Personal Data Regulations.

4. TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN UNION

Some of the recipients mentioned above may be part of groups of companies whose holding entity is located outside the European Economic Area. As a result, some Personal Data of Data Subjects may be transferred to third countries (in particular to the United States), in particular as a result of legal, governmental or judicial obligations to disclose data, regardless of where this data is hosted.

 

SURGAR ensures at all times that these transfers are made under appropriate and appropriate security and confidentiality conditions to guarantee a level of protection of Personal Data equivalent to the level required within the European Union, in accordance with the Regulations applicable to the protection of Personal Data, in particular by concluding with its service providers standard contractual clauses adopted by the European Commission which govern the transfers.

5. RIGHTS OF DATA SUBJECTS OVER THEIR PERSONAL DATA

The Data Subject has, at any time, the following rights over his or her Personal Data:

 

  • Right of access : to obtain confirmation of the processing of their Personal Data as well as a certain amount of information on the processing, it being understood that this information is in any case given in this document;
  • Right to rectification : obtain the rectification of their Personal Data when they are inaccurate or incomplete;
  • Right to erasure, also known as the “right to be forgotten”: obtain the erasure of their Personal Data when they are no longer necessary in relation to the purposes for which they were collected or when the Data Subject objects to the processing of their Personal Data; 
  • Right to restriction of processing : to obtain the restriction of the processing of his/her personal data when the Data Subject contests the accuracy of the data, when the retention period for the Personal Data has expired but the Data Subject still needs to keep this Personal Data for the establishment, exercise or defense of a legal claim,  or if the Data Subject has objected to the processing;
  • Right to portability : obtain the communication of the Personal Data that the Data Subject has communicated to SURGAR in a readable format, or request that SURGAR transmit the Personal Data that the Data Subject has communicated to another data controller;
  • Right to object : to object at any time, for reasons relating to their personal situation, to the processing of their Personal Data, in particular in the event that this opposition concerns commercial prospecting, including profiling;
  • Withdrawal of consent : withdraw consent to the future processing of their Personal Data by SURGAR, where the processing is based on consent;
  • Right to make advance directives: to make advance directives about the use of their Personal Data after their death (e.g., retention, deletion, disclosure), modify or withdraw them at any time;
  • Right to lodge a complaint : lodge a complaint with the French Authority “Commission Nationale de l’Informatique et des Libertés” (“CNIL“) if the Data Subject considers that the processing carried out by SURGAR constitutes a violation of his or her Personal Data. To exercise their rights, the Data Subject is invited to contact SURGAR, specifying in the subject line of their letter or email that it is a request for information or a complaint relating to their Personal Data, and will provide proof of receipt of their request. The Data Subject will be asked for an identity document to prove his or her identity.

6. SECURITY MEASURES IMPLEMENTED

SURGAR undertakes to make its best efforts to implement and maintain security and confidentiality measures for the Site, which take into account the principles of Personal Data protection, and are adapted to the risk generated by their processing on the rights and freedoms of Data Subjects, in accordance with the requirements of the Personal Data Regulations. These measures are intended to (i) protect Personal Data against destruction, loss, alteration, disclosure to unauthorized third parties and (ii) ensure the restoration of the availability of and access to Personal Data in an appropriate time frame in the event of a physical or technical incident. SURGAR implements a procedure to regularly test, analyze and evaluate the effectiveness of the aforementioned security measures.

7. HYPERTEXT LINKS

The Site may contain hypertext links to third-party websites. SURGAR has no control over the content of third-party websites referenced by hypertext links. These websites are published by third-party companies independent of SURGAR. SURGAR cannot therefore assume any responsibility for the content, advertising, services or any other information or data available on or from the Site. Thus, the Data Subject acknowledges that he/she is solely responsible for access to and use of the Site. SURGAR cannot be held liable for any damage or loss, proven or alleged, resulting from or in connection with the use or reliance on the content, goods or services available on these sites.

 

The Data Subject is not authorized to create a hypertext link to the Website. The creation of links to the Site or other SURGAR websites is only possible with the prior and express consent of SURGAR.

8. COOKIE MANAGEMENT

SURGAR uses cookies for the proper purposes of the operation of the Site and to monitor and analyze traffic on it. A ” cookie ” is a small data file sent to the Data Subject’s browser by a web server and stored on the hard drive of his or her computer or other computer medium. They are not likely to damage the said support in any way. 

 

The information collected through cookies is solely and strictly intended for SURGAR, in compliance with the Personal Data Regulation. Cookies from third-party publishers allow these publishers to access the information collected through their cookies, according to the terms and conditions specified in the table below.

 

In order to process cookies, SURGAR uses the services of a subprocessor (InnoCraft Limited) which allows them to be anonymized as soon as they are collected, so that they are no longer considered as Personal Data. The Data Subject is invited to read the subprocessor’s privacy policy at the following address: matomo.org.

9. EVOLUTION OF THE PRIVACY POLICY

This Privacy Policy may be modified, supplemented or updated at any time by SURGAR, in particular in order to take into account any legal, regulatory, jurisprudential and/or technical developments, with the aim of constantly guaranteeing the best protection of Data Subjects’ Personal Data. The Data Subject is invited to regularly consult the Privacy Policy to stay informed of the processing carried out by SURGAR on the processing of his or her Personal Data. If the Data Subject does not agree with the terms of the new wording of the Privacy Policy, he or she is free to request the deletion of his or her Personal Data under the conditions and in accordance with the procedures provided for in Article 5 above.
